Michael Batty heads our provision of dispute resolution services to the construction and engineering sector. advice to a private hospital group on collateral warranties received from building contractors and professional consultants;

representing a developer in relation to a claim against a professional contractor concerning alleged inadequate ground preparation which resulted in additional soil treatment costs before the commencement of construction work;

advising the owners of a property bought for refurbishment in relation to a claim for negligence and breach of contract against the appointed building contractor;

advising on a building contract for a commercial property development;

settling warranties, bonds and guarantees for tenants on new build, high-value, science park units;

advising clients in relation to the extent of a restricted NHBC policy and negotiating with the insurer to secure the completion of remedial works under the policy;

recovering fees for an architect relating to a development project;

preparation of a construction joint venture agreement for a landowner and residential developer; and

advising the directors and shareholders of a building contractor entering an insolvency process, including the mitigation of loss for creditors, assisting in the assignment of on-going projects to new contractors and advising on the subsequent investigation by the Official Receiver.
