Insolvency advice

Examples of our work include:

Successfully resisting a claim by a Trustee in Bankruptcy who maintained that our client’s purchase of a care home from a business that then became insolvent was void, as a “transaction at an undervalue”;

Advising the shareholders of a manufacturing business facing insolvency on how to save that business by purchasing its assets and reemploying all staff, our proposal being supported by a Bank and Licensed Insolvency Practitioner;

Advising a retail business based in London on a very cost effective purchase of a competitor’s business from its Liquidators;

Acting for liquidators pursuing claims against debtors of a company, and on claims against former directors;

Advising the owners of a business facing insolvency on their responsibilities, enabling them to take steps to restructure and save the business whilst fully discharging their statutory responsibilities as directors; and

Advising on the annulment and discharge of a bankruptcy orders.

Publications of note include: “Non-Resident Directors Must Assist Liquidators” (International Law Office); “Misfeasance by Directors: an Alternative to Fraudulent Trading” (Financier Worldwide); and “Corporate Rescue: The Need for Legislation in Hong Kong” (INSOL World).
