March 2010BMS Computer Solutions Ltd v AB Agri Ltd |
Greene & Greene has secured a major victory for client BMS Computer Solutions Limited. BMS supplies computer software and support services to customers in the animal feed industry. Partner Neil Walmsley has acted for BMS since the early 1990s, advising on its agreements and other commercial issues.
Customer AB Agri challenged those agreements, alleging that it could continue to use BMS software without paying for support. AB Agri is a UK market leader in the industry with turnover exceeding £770m. AB Agri instructed national firm, Addleshaw Goddard to advance its arguments.
In November 2009 we issued High Court proceedings and instructed Vernon Flynn QC to represent BMS in the Royal Courts of Justice. Within four months we had secured summary judgement in favour of BMS, confirming its position and the validity of its agreements. |
